Judge Katherine Polk Failla of the US District Court of the Southern District of New York allowed the SEC’s lawsuit against Coinbase to proceed. The SEC’s allegations suggest that Coinbase may be operating as an unregistered securities exchange. Additionally, they propose it may function as an unregistered broker and clearing agency. This is particularly true through its Staking Program, which could involve the unregistered offering and sale of securities. Judge Failla’s ruling acknowledged that the SEC had sufficiently pleaded its case against Coinbase. Consequently, this marks another hurdle for the exchange to overcome.
